U.S. Customs and Border Protection (CBP) has announced a Notice of Proposed Rulemaking (NPRM) to strengthen oversight of low-value shipments, also known as de minimis shipments. With over 4 million such shipments entering the U.S. daily, CBP’s proposed Entry of Low-Value Shipments (ELVS) rule seeks to enhance supply chain visibility and improve the agency’s ability to interdict high-risk goods.

The current process for low-value shipments requires minimal data from importers, limiting CBP’s ability to identify and intercept dangerous items like counterfeit goods, illicit drugs, and other contraband. By introducing additional data requirements through an electronic entry system, the ELVS rule aims to provide actionable insights, allowing CBP to better target high-risk shipments.

“Every day, CBP officers interdict goods that threaten public safety and economic stability,” said Pete R. Flores, Senior Official Performing the Duties of the Commissioner. “This proposed rule will equip us with tools to address these threats while supporting safe and lawful trade.”

The NPRM represents part of a broader strategy to modernize trade and address vulnerabilities in the growing segment of international low-value shipments. The changes are designed to streamline the process for lawful shipments while ensuring that resources remain focused on intercepting violative goods, including counterfeit items and the precursors used to produce synthetic opioids like fentanyl.
